These Terms & Conditions (“Terms”) govern your access to and use of Messenger (the “Service”), including public communities, private chats, posts, profiles, media, follows, notifications, and moderation features. The Service is powered by Action Apps. By accessing or using the Service, you agree to these Terms.
1. Eligibility and accounts
You must be at least 13 years old and legally able to enter into these Terms. You must provide accurate account information, protect your login credentials, and promptly report suspected unauthorized access. You are responsible for activity performed through your account unless caused by a security failure within the Service.
2. Public and private content
Public communities and public profiles may be visible to anyone and indexed by search engines. Private chats and private groups are limited to authorized participants, but you should not assume that another participant will keep information confidential. Do not submit passwords, financial account numbers, medical records, government identifiers, or other highly sensitive information.
3. Anonymous posting
Some communities may allow anonymous posting. Anonymous status hides your public identity from ordinary users but not from the Service’s internal records or authorized moderators. We may use internal identity information to investigate abuse, enforce rules, respond to legal obligations, and protect users.
4. Community rules and participation
A community may publish additional rules. When rules are present, you must accept and follow them before posting. Community owners and moderators may remove content, limit participation, approve or deny membership, or take other reasonable moderation action. Community rules supplement these Terms and cannot authorize conduct prohibited by these Terms or applicable law.
5. Prohibited conduct
You may not use the Service to:
- harass, threaten, stalk, exploit, impersonate, or unlawfully discriminate against another person;
- publish unlawful, defamatory, fraudulent, deceptive, or privacy-invasive content;
- share sexual content involving minors or facilitate child exploitation;
- promote violence, terrorism, self-harm, or credible threats;
- send spam, scams, malware, phishing, bulk solicitation, or deceptive links;
- infringe copyrights, trademarks, privacy rights, publicity rights, or other rights;
- access accounts, systems, data, or private networks without authorization;
- evade posting blocks, suspensions, content removals, rate limits, or moderation controls;
- automatically scrape, crawl, copy, or harvest the Service except with written permission;
- interfere with availability, security, or normal operation of the Service.
6. Abuse reports and automatic moderation
Users may flag content for abuse. The Service may automatically remove a post after more than three qualifying flags and may block an account from posting in a particular community after its community abuse score exceeds three. Automated action may be reviewed, reversed, or supplemented by a moderator. Submitting knowingly false or coordinated reports is itself prohibited.
7. Your content and license
You retain ownership of content you create. You grant the Service operator a worldwide, non-exclusive, royalty-free license to host, store, reproduce, format, display, transmit, distribute, and technically modify your content as necessary to operate, secure, promote, and improve the Service. For public content, this license includes displaying it to visitors and search engines. The license ends when content is deleted from active systems, except for reasonable backup, moderation, legal, and archival retention.
8. Content responsibility
You represent that you have the rights and permissions needed to submit your content. You are responsible for your posts, messages, uploads, links, and interactions. The Service does not endorse user content and does not guarantee its accuracy, legality, safety, or usefulness.
9. Links and third-party services
Posts may include previews and links to third-party websites. Third-party sites are not controlled by the Service, and their content, security, availability, and practices are their responsibility. Opening external links is at your own risk and may be subject to separate terms and privacy policies.
10. Notifications
Following users or threads may generate in-app or email notifications, including a preview of up to 250 characters. Delivery is not guaranteed and may be delayed, filtered, duplicated, or interrupted. You are responsible for managing follow settings and maintaining a valid email address.
11. Intellectual property of the Service
The Service software, interface, branding, graphics, and related materials—excluding user content—are owned by or licensed to the Service operator or Action Apps and are protected by applicable intellectual-property laws. These Terms do not grant permission to copy, resell, reverse engineer, or create derivative services except where applicable law cannot restrict that activity.
12. Suspension and termination
We may restrict, suspend, or terminate access; remove content; preserve evidence; or contact appropriate authorities when reasonably necessary to enforce these Terms, protect the Service or others, investigate misconduct, comply with law, or address security risks. You may stop using the Service at any time.
13. Service availability and changes
The Service may be changed, interrupted, limited, or discontinued at any time. Features may be experimental and may not operate without errors. We do not guarantee uninterrupted availability, message delivery, data preservation, search-engine indexing, notification delivery, or recovery of deleted material.
14. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, security, or availability.
15. Limitation of liability
To the fullest extent permitted by law, the Service operator, Action Apps, and their owners, personnel, contractors, affiliates, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, goodwill, or opportunities; unauthorized user conduct; third-party content; or service interruption. Where liability cannot be excluded, total liability arising from the Service will not exceed the greater of $100 or the amount you paid specifically for the Service during the six months before the event giving rise to the claim.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless the Service operator, Action Apps, and their affiliates and personnel from claims, losses, liabilities, damages, and reasonable expenses arising from your content, your violation of these Terms, your unlawful conduct, or your infringement of another person’s rights.
17. Governing law
Unless mandatory law requires otherwise, these Terms are governed by the laws of the state in which the Service operator is established, without regard to conflict-of-law principles. Any claim must be brought in a court with jurisdiction over the Service operator’s principal place of business.
18. Changes to these Terms
We may revise these Terms as features, legal requirements, or business practices change. Revised Terms will be posted with a new effective date. Continued use after that effective date constitutes acceptance of the revised Terms.
19. Severability and entire agreement
If a provision is unenforceable, the remaining provisions remain effective. These Terms, the Privacy Policy, and applicable community rules form the agreement governing your use of the Service.
